These Terms & Conditions ("Terms") govern your access to and use of Haunts365 services—including our website, official guest mobile application, and ticketing and guest features—and your attendance at events operated by Haunts365 Limited Liability Corporation ("Haunts365," "we," "us," or "our"). By purchasing tickets, creating a guest account, using our app or website, or attending our event, you agree to these Terms.

Privacy commitment: Haunts365 will never sell your personal information. Details are in our Privacy Policy. We aim to earn your trust through clear practices and by honoring the commitments we publish there.

By purchasing and/or using a ticket, you acknowledge and voluntarily assume all risks associated with an immersive haunted attraction, including but not limited to:

You agree that participation is voluntary and at your own risk. To the fullest extent permitted by law, you release and hold harmless Haunts365 and its owners, officers, employees, contractors, and affiliates from claims for personal injury, emotional distress, illness, loss, theft, or property damage arising from participation, except where liability cannot be waived under applicable law.

4. Health and Safety Notice

This attraction may not be suitable for individuals with certain medical conditions (including heart conditions, seizure disorders/photosensitivity, severe motion sensitivity/kinetosis, vertigo-related conditions, and pregnancy-related limitations). You acknowledge that effects can include nausea, dizziness, disorientation, vomiting, and similar physical reactions. You are solely responsible for evaluating your fitness and choosing whether to participate.

5. Prohibited Items and Conduct

The following are prohibited on premises:

Guests are financially responsible for any damage, loss, or destruction to Haunts365 property or equipment caused by intentional acts, reckless conduct, or policy violations. Haunts365 may pursue recovery of repair/replacement costs, related losses, and associated legal/collection fees to the extent permitted by law.

All website and guest app content, branding, text, design, graphics, and media are owned by or licensed to Haunts365 and protected by applicable law. You may not copy, distribute, or commercially exploit content without prior written permission.

8. Camera Surveillance and Media Release

For safety, security, quality control, fraud prevention, and incident review, Haunts365 uses video surveillance and monitoring in and around the venue, including at entry/exit and operational areas. By entering the property and/or attraction, you acknowledge and consent to being photographed and recorded.

By entering the venue, you grant Haunts365 and its designees a perpetual, worldwide, royalty-free right and license to use, reproduce, publish, display, distribute, edit, and create derivative promotional materials from your likeness, voice, image, and appearance captured in photo/video/audio for marketing, advertising, social media, website content, and other lawful business purposes, without additional notice, approval, or compensation, except where prohibited by law.

If you do not consent to capture/use of your likeness, do not enter the venue.

9. Limitation of Liability

To the fullest extent permitted by law, Haunts365's total liability for any claim arising out of or relating to tickets, website use, or attendance will not exceed the amount paid for the applicable ticket(s).

10. Indemnification

You agree to indemnify, defend, and hold harmless Haunts365 from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your misconduct, policy violations, or unlawful acts.

11. Dispute Resolution; Class Action Waiver

To the fullest extent permitted by law, disputes shall be resolved on an individual basis and not as a class, collective, or representative action. You waive any right to participate in class action litigation against Haunts365. Venue/jurisdiction for disputes is governed by applicable law in Collier County, Florida.

12. Policy Changes

Haunts365 may update these Terms at any time by posting updates to this page. Continued use of our website/services constitutes acceptance of the revised Terms.
